A Kahnawake licence is an authorization from the Kahnawake Gaming Commission, the body that licenses gaming within and from the Mohawk Territory of Kahnawà:ke near Montréal. It covers online operators hosted in the Territory and gives players a written complaint route, but it is not a provincial licence and does not replace provincial rules.

Who the Kahnawake Gaming Commission is

The Kahnawake Gaming Commission (KGC) describes itself as the "licensing and regulating authority for gaming activity within and from the Mohawk Territory of Kahnawà:ke". Its mailing address is P.O. Box 1799, Kahnawà:ke, QC J0L 1B0, on the south shore of the St. Lawrence opposite Montréal.

According to the KGC FAQ, the Commission was established on June 10, 1996 under the Kahnawake Gaming Law (MCR No. 26/1996-97). It has three members, appointed for two-year terms by the Mohawk Council of Kahnawà:ke. The FAQ also notes that in 2007 the Superior Court of Québec "favourably considered" the Commission's authority.

The Commission regulates both online and land-based gaming. On the land-based side it licenses poker rooms, raffles and electronic gaming devices in the Territory, which is relevant if you visit from the Montréal area.

The rules: Regulations concerning Interactive Gaming

Online gaming is governed by the Regulations concerning Interactive Gaming, first enacted on 08 July 1999 and last amended on 25 March 2026. Key points from the text:

  • Scope (s.1): the Regulations apply to gaming offered from the Territory, including to players located outside it.
  • No unlicensed play (s.5): no one may offer interactive gaming from the Territory without a valid Authorization.
  • Local laws (s.6): Authorized Client Providers are responsible for conforming to the laws of "comparable jurisdictions", including advertising laws.
  • Age: the "approved age" is the greater of 18 or the age required in the player's jurisdiction of residence.
  • Dormant accounts (s.259 and s.260): operators must have a dormant account policy.

The KGC's interactive gaming page adds a physical requirement: licensed online operators "must be hosted at Mohawk Internet Technologies, a data centre located within the Mohawk Territory", which is managed by Continent 8 Technologies.

The five types of authorization

Section 10 of the Regulations lists five authorizations. The table sets out what each is for and the figures the Regulations attach to them.

AuthorizationWhat it coversFigures in the Regulations
Interactive Gaming LicenceThe base licence; other authorizations are appended to itCPAs and CSPAs are valid only while it is in good standing (s.11 and s.12)
Client Provider Authorization (CPA)An operator offering games to playersApplication fee $35,000; initial term 6 months (s.38); renewal fee $5,000 (s.168)
Casino Software Provider Authorization (CSPA)A software supplierAppended to a valid Interactive Gaming Licence
Live Dealer Studio AuthorizationA live dealer studioListed in s.10(d)
Key Person PermitIndividuals in key rolesFee $5,000 per person

At review, the Commission considers factors including "an inordinate number of complaints" (s.42), and a CPA can be renewed for up to five years or extended once for three months (s.43). The KGC has also announced that fees for CPAs and Key Person Permits rise from January 1, 2027.

How to check that a site really holds a Kahnawake licence

Section 269 requires operators to display the KGC logo linked to a Certificate of Good Standing, together with a notice that complaints go to the operator first and then to the Commission. The FAQ confirms that the logo should link to that certificate and that the Commission's Permit Holders page lists CPAs by operator.

A logo that links nowhere, or to a picture rather than a certificate on gamingcommission.ca, is a warning sign. The same check works for any licence claim, as covered in how sites are rated.

The complaint process, step by step

Part XXIV of the Regulations and the KGC complaints page set out the procedure.

  1. Complain to the operator first. Section 267 requires every operator to offer dispute resolution with recourse to the Commission.
  2. Wait for a final decision. Under s.270 the operator has 45 days. If you are dissatisfied, or no decision arrives, you may go to the Commission notwithstanding the operator's terms and conditions.
  3. Skip the wait in serious cases. The Commission may accept a complaint early where it involves underage gambling, problem gambling, responsible gambling or self-exclusion, or alleged fraud or seizure of funds.
  4. File in writing within six months. Section 271 requires a written complaint with details, and s.272 sets a six-month window from when the matter arose, extended if the matter was already with the operator.
  5. Include the required details: full name, email, date of birth, country of residence, site name, username or member number, date and a description. Submit by email to [email protected] or through the online form; phone submissions are not accepted.
  6. The operator replies to the Commission within 7 days (s.275).
  7. The Commission decides. Under s.277 it can dismiss the complaint, uphold it, direct the operator to take steps, award costs or make another order.

What a Kahnawake licence does not do

The licence has clear limits, and most of them follow from the documents above.

  • It does not cover unlicensed sites. The complaints page says only permit holders are covered.
  • It does not take every complaint. The KGC does not handle complaints already addressed, handled by another jurisdiction or already ruled on, nor complaints that have been "discussed on a public forum" or shared with the media. Section 280 allows vexatious or out-of-scope complaints to be dismissed.
  • It does not promise compensation. The outcomes in s.277 are orders the Commission may make, not a guarantee fund.
  • It is not a provincial licence. Under Criminal Code s.207(1)(a), provinces conduct and manage lottery schemes in their own territory. In Ontario, only sites in the iGaming Ontario market may take bets from players located there; see the Ontario page.
  • It does not shift responsibility for local law away from the operator. Section 6 places that duty on the Client Provider.

The relationship with Ontario has been contested. The KGC reports that the Mohawk Council of Kahnawà:ke filed legal action on November 28, 2022 in the Ontario Superior Court against iGaming Ontario and the Attorney General of Ontario over the meaning of "conduct and manage". The KGC itself was not a party. On May 13, 2024 Justice Brownstone dismissed the application, finding iGaming Ontario to be the "operating mind" of the Ontario model, as summarized by Blakes.

Checklist before you deposit with a Kahnawake-licensed site

  • Click the KGC logo and confirm it opens a Certificate of Good Standing on gamingcommission.ca.
  • Find the operator on the Permit Holders page.
  • Read the site's dispute section; s.269 requires it to explain that complaints go to the operator first, then the Commission.
  • Keep records: dates, emails, chat transcripts and balance screenshots, since the complaint form asks for dates and details.
  • Do not post the dispute on a forum or send it to the media before the KGC has dealt with it, or it may be refused.
  • File within six months of the problem arising.
  • Check your province's rules first. If you are in Ontario, the regulated market is the legal option.
  • If gambling is causing harm, use self-exclusion tools and the help listed on the responsible gambling page.

Frequently asked questions

Is a Kahnawake licence legal in Canada?

The Kahnawake Gaming Commission licenses gaming within and from the Mohawk Territory of Kahnawà:ke, and its FAQ notes that the Superior Court of Québec favourably considered its authority in 2007. Provinces separately conduct and manage gambling under Criminal Code section 207, and in Ontario only sites in the iGaming Ontario market may take bets from players located there.

How long do I have to file a complaint with the KGC?

Section 272 of the Regulations concerning Interactive Gaming sets a six-month window from when the matter arose, extended where the complaint was already with the operator. You normally go to the operator first and wait up to 45 days for its final decision before turning to the Commission.

Can I complain to the KGC by phone?

No. The KGC complaints page says phone submissions are not accepted. Complaints go by email to [email protected] or through the online form, and must include your name, email, date of birth, country, the site name, your username, the date and details.

What is the minimum age on Kahnawake-licensed sites?

The Regulations define the approved age as the greater of 18 or the age required in the player's jurisdiction of residence. A player whose province sets a higher gambling age is therefore held to that higher age.
